<blockquote><p><b>Washington, DC</b> – Today U.S. Senator Bob Casey (D-PA) Mary Landrieu (D-LA) and Congressman Bruce Braley (D-IA) introduced the Adoption Tax Credit Refundability Act of 2013. The bill would make the Adoption Tax Credit fully refundable. Making the tax credit refundable would extend its benefits to more Americans. According to IRS data, 62% of filers in 2011 benefited from the refundable Adoption Tax Credit.</p>
<p>“Making the Adoption Tax Credit refundable will support and encourage adoption by assisting families with some of the costs,” <b>Senator Casey said</b>. “The Adoption Tax Credit has been a proven success in increasing families’ ability to offer permanent homes to adoptive children. Making the credit refundable will allow more families to experience its benefits.”</p>
<p>&#8220;My husband and I are blessed with two precious, adopted children, and I know the Adoption Tax Credit encourages many families to consider expanding their own through adoption,&#8221; <b>Senator Landrieu said</b>. &#8220;Without the tax credit being refundable, many adopting families can’t fully utilize the benefits of this credit to make adoption a reality. This change will especially help families that want to adopt foster youth, finally providing them with a permanent and loving family and ensuring foster care is only temporary. I am committed to making the Adoption Tax Credit refundable and look forward to working with my colleagues on both sides of the aisle to continue to support families who make the wonderful decision to adopt.&#8221;</p>
<p>“The Adoption Tax Credit Refundability Act makes the tax credit even better by making it refundable,” <b>Congressman Braley said</b>.”  “That means more families can take full advantage of the tax cut, providing a better incentive to families considering adoption. That will help more children in need end up in loving homes.”</p>
<p>The adoption tax credit was made permanent in the American Taxpayer Relief Act in January 2013.  However, that law did not extend the refundability provisions that applied to the adoption tax credit in 2010 and 2011.  The Adoption Tax Credit Refundability Act will restore the refundable portion of this critical support for families wishing to adopt.</p>
<p>According to the Department of Health and Human Services, one-third of all adopted children live in families with annual household income at or below 200 percent of the poverty level.  Despite the common misperception that only wealthy families adopt, nearly 46 percent of families adopting from foster care are at or below 200 percent of the federal poverty level.  Many of these families’ tax burdens are so low that they cannot benefit from the adoption tax credit at all unless it is refundable.</p>
<p>Preliminary 2011 data indicate that nearly 62 percent of families who filed for the adoption tax credit benefited from refundability.  Forty-one percent of families who benefited from refundability (25 percent of all families who took the tax credit) had adjusted gross incomes under $50,000.</p>
<p>These data indicate that a refundable adoption tax credit plays a significant role in lower-income families’ ability to adopt and support a child from foster care.  Older data from a 2006 study cited by HHS demonstrate a significant financial benefit to society, as well: the cost of adoption and permanency is significantly lower than the cost to federal, state and local governments to provide long-term foster care.</p></blockquote>

For many of these children international adoption is their best hope. For all of these children family is their greatest need. And, ultimately Jesus is their only hope.</p>
<p>Jesus tells us that our love for Him is only as great as our love for the least of these (Matthew 25). That said, <strong>t</strong><strong>here should be no children without families where the church exists. </strong></p>
<p>The current international adoption system is broken. In just the last 10 years the number of children who have been adopted has been cut by over 60%. The number of adoptions continues to decline while the number of orphans increases. The new documentary Stuck seeks to raise awareness to this problem and is movement to provide change for the sake of these children. Speaking to His people who have been exiled by the Babylonians and in fear of mixing with them, God says through His prophet:</p>
<blockquote><p><em>“Multiply there (in the city), and do not decrease. But seek the welfare of the city where I have sent you into exile, and pray to the lord on it’s behalf, for in it’s welfare you will find your welfare ” <a href="http://www.gnpcb.org/esv/search/?q=Jeremiah+29%3A6-7">Jeremiah 29:6-7</a></em></p></blockquote>
<p>When we think about seeking the “welfare of our city” there is much we can do. The needs are many. Amidst it all, the need of caring for the orphans of the city is massive. In any given metropolis in America there are literally <strong>hundreds of children that have no family and no permanent home</strong>. Over 400,000 children in America are in foster care. Over 104,000 children are literal orphans with no permanent family, most of whom are living in the neighborhoods of our cities.  In Austin, TX alone there are 244 of these dear children that are waiting to be adopted.</p>
<p>Imagine if the church took seriously this call to “seek the welfare of the city” and made caring for every child in foster care and every child available for adoption a part of that mission. What if the church became more known for its care of the children than for what it is against in our cities.</p>
<p>What if our cities were filled only with waiting parents instead of waiting children!</p>
<p>Providing permanent families for all the waiting children in our city is not an impossible task. It may just be the greatest opportunity the church has today to seek the renewal of our cities for God&#8217;s glory!</p>

<p>I will never forget the day that we walked into the adoption agency and met our son for the first time. He was perfect at just two-weeks old. The most beautiful little boy I had ever seen. And he was ours. We felt an indestructible hopefulness and joy.</p>
<p>I will also never forget the day that our son wouldn&#8217;t stop screaming and was unconsolable because he was afraid of being abandoned again. The experience of loss still resonating deep in his little soul somehow stirred up. My wife and I felt helpless at best.</p>
<p><em><strong>An honest approach to adoption involves both profound brokenness and beauty.</strong> </em></p>
<p>Sometimes it seems like there is more beauty than brokenness and sometimes it is the other way around. A schizophrenic mix of hope and hopelessness. Helplessness and joy.</p>
<p>Through it, thankfully, we are pushed, reminded, driven, and invited into the only hope and help we have &#8211; Jesus. And if we are lucky, a community of others who are in the same boat, reminding us we are not alone in this journey.</p>

In Paul’s world, adoption was ordinarily of young adult males of good character to become heirs and maintain the family name of the childless rich. Paul, however, proclaims God’s gracious adoption of persons of bad character to become “heirs of God and co-heirs with Christ” (<a href="http://biblia.com/bible/esv/Rom.%208.17" target="_blank">Rom. 8:17</a>).</p>
<p>Justification is the basic blessing, on which adoption is founded; adoption is the crowning blessing, to which justification clears the way. Adopted status belongs to all who receive Christ (<a href="http://biblia.com/bible/esv/John%201.12" target="_blank">John 1:12</a>). The adopted status of believers means that in and through Christ God loves them as he loves his only-begotten Son and will share with them all the glory that is Christ’s now (<a href="http://biblia.com/bible/esv/Rom.%208.17" target="_blank">Rom. 8:17</a>, <a href="http://biblia.com/bible/esv/Rom%208.38-39" target="_blank">38-39</a>). Here and now, believers are under God’s fatherly care and discipline (<a href="http://biblia.com/bible/esv/Matt.%206.26" target="_blank">Matt. 6:26</a>; <a href="http://biblia.com/bible/esv/Heb.%2012.5-11" target="_blank">Heb. 12:5-11</a>) and are directed, especially by Jesus, to live their whole lives in light of the knowledge that God is their Father in heaven. They are to pray to him as such (<a href="http://biblia.com/bible/esv/Matt.%206.5-13" target="_blank">Matt. 6:5-13</a>), imitate him as such (<a href="http://biblia.com/bible/esv/Matt.%205.44-48" target="_blank">Matt. 5:44-48</a>; <a href="http://biblia.com/bible/esv/Matt%206.12" target="_blank">6:12</a>, <a href="http://biblia.com/bible/esv/Matt%206.14-15" target="_blank">14-15</a>; <a href="http://biblia.com/bible/esv/Matt%2018.21-35" target="_blank">18:21-35</a>; <a href="http://biblia.com/bible/esv/Eph.%204.32-5.2" target="_blank">Eph. 4:32-5:2</a>), and trust him as such (<a href="http://biblia.com/bible/esv/Matt.%206.25-34" target="_blank">Matt. 6:25-34</a>), thus expressing the filial instinct that the Holy Spirit has implanted in them (<a href="http://biblia.com/bible/esv/Rom.%208.15-17" target="_blank">Rom. 8:15-17</a>; <a href="http://biblia.com/bible/esv/Gal.%204.6" target="_blank">Gal. 4:6</a>).<br />
Adoption and regeneration accompany each other as two aspects of the salvation that Christ brings (<a href="http://biblia.com/bible/esv/John%201.12-13" target="_blank">John 1:12-13</a>), but they are to be distinguished. Adoption is the bestowal of a relationship, while regeneration is the transformation of our moral nature. Yet the link is evident; God wants his children, whom he loves, to bear his character, and takes action accordingly.</p></blockquote>

<p>In light of the <a href="http://abbafund.wordpress.com/2013/01/02/federal-adoption-tax-credit-is-made-permanent/">recent vote </a>to make the Federal Adoption Tax Credit permanent I have updated some of the information here. We will continue to update as more details are released.</p>
<p>We receive A LOT of questions about the Adoption Tax Credit and I wanted to compile as much information as possible for you.</p>
<p>While this should give you a basic understanding of the credit I encourage you to talk to a tax professional about your personal situation if you have specific questions.</p>
<h3><strong>The Federal Adoption Tax Credit</strong></h3>
<p>Taxpayers who adopt a child domestically or internationally may qualify for the <strong>adoption tax credit</strong>.</p>
<p>You qualify for the adoption tax credit if you adopted a child and paid out-of-pocket expenses relating to the adoption. The amount of the tax credit you qualify for is dependent upon how much money you spent on adoption-related expenses. If you adopt a special needs child through the State you can claim the full amount of the adoption credit, even if your out-of-pocket expenses are less than the tax credit amount.</p>
<p>The adoption credit is calculated on <a href="http://www.irs.gov/pub/irs-pdf/f8839.pdf" target="_blank">Form 8839 Qualified Adoption Expenses</a> (PDF). You may claim an adoption credit of up to $12,770 (preliminary estimate for tax year 2013) per eligible child.</p>
<h3>Adoption Tax Credit Amounts</h3>

<h3>Adoption Tax Credit Phase-out Ranges</h3>
<blockquote><p><strong>2013 </strong>The credit begins to phase out at incomes above $190,000.</p>
<p><strong>2011</strong>: $185,210 &#8211; $225,210<br />
<strong>2010</strong>: $182,520 &#8211; $222,520<br />
<strong>2009</strong>: $182,180 &#8211; $222,180<br />
<strong>2008</strong>: $174,730 &#8211; $214,730<br />
<strong>2007</strong>: $170,820 &#8211; $210,820<br />
<strong>2006</strong>: $164,410 &#8211; $204,410</p></blockquote>
<p>The IRS provides a worksheet for figuring your modified adjusted gross income for the adoption credit in the <a href="http://www.irs.gov/instructions/i8839/index.html" target="_blank">Instructions for Form 8839</a>. Any income excluded from tax using the <a href="http://taxes.about.com/od/taxhelp/a/ForeignIncome.htm">Foreign Earned Income Exclusion</a> must be added back for the purposes of determining the phase-out range for the adoption credit.</p>
<h3>Adoption Credit Refundable in 2010 and 2011</h3>
<p>The adoption credit was scheduled to sunset at the end of 2010. However, the massive <a href="http://taxes.about.com/b/2010/03/30/tax-provisions-in-the-health-care-reform-law.htm">health care reform legislation</a> extended and revised the adoption tax credit. The health care legislation also enhanced the adoption tax credit in three ways. First, it bumped the maximum adoption credit from $12,150 to $13,170. Second, it extended this increased tax credit amount to the year 2011. Third, it made the <a href="http://taxes.about.com/b/2010/10/04/enhanced-adoption-credit-for-2010.htm">adoption credit refundable</a> which meant a full payout for adoptive families. This caused many issues for the IRS and families receiving their returns and many having to send in proof of expenses and documentation for their adoption. There are still families today that are working on receiving their 2011 returns. The <a href="http://taxes.about.com/b/2010/12/20/the-tax-relief-act-of-2010-income-tax-provisions.htm">Tax Relief Act</a> extended increased dollar amounts for an additional year, through 2012.</p>
<h3>Adoption Tax Credit Eligibility Requirements</h3>
<p>To be eligible for the adoption credit, you must:</p>
<ul>
<li>Adopt an eligible child, and</li>
<li>Pay qualified adoption expenses out of your own pocket.</li>
</ul>
<p><strong>Eligible Children</strong> include:</p>
<ul>
<li>any child age 17 or younger, or</li>
<li>a child of any age who is a US citizen or resident alien and who is physically or mentally incapable of caring for himself or herself.</li>
</ul>
<p><strong>Qualified Adoption Expenses</strong> are calculated by:</p>
<ul>
<li>Adding up all the expenses related to the adoption,</li>
<li>Subtracting any amounts reimbursed or paid for by your employer, government agency, or other organization.</li>
</ul>
<p>Adoption expenses include any and all costs directly relating to your adoption and that are reasonable and necessary for your adoption. Expenses include adoption fees, legal fees, court costs, and travel expenses.</p>
<p><strong>Taxpayers who adopt a special needs child</strong> can claim the full amount of the adoption credit without regard to the actual expenses paid in the year the adoption becomes final.</p>
<p><strong>Eligible expenses</strong> must be &#8220;directly related&#8221; to the adoption of an eligible child. This may include adoption fees, legal fees, and court costs. Expenses for a failed adoption might qualify for the credit if followed by a successful adoption, but the two adoption efforts would be considered as one adoption and subject to the dollar limit per eligible child. The editors of <a href="http://taxes.about.com/od/taxbooks/fr/jklasser.htm">JK Lasser&#8217;s Your Income Tax</a> advise:</p>
<blockquote><p>&#8220;Do not include expenses paid or reimbursed by your employer or any other person or organization. You may not claim a credit for the costs of a surrogate parenting arrangement or for adopting your spouse&#8217;s child.&#8221; (page 469)</p></blockquote>
<h3>When to Claim the Adoption Credit</h3>
<p>What year you can claim the adoption credit depends on when the adoption was finalized and whether the adopted child is a US citizen, resident alien, or foreign national.</p>
<p><strong>If the child is a US citizen or resident alien</strong>, then you take the adoption credit in the following order:</p>
<ul>
<li>for expenses paid before the adoption is final, you take the adoption credit in the year after your expenses were paid,</li>
<li>for expenses paid in the same year that the adoption is final, you take the adoption credit in the same year, and</li>
<li>for expenses paid in the year after the adoption is final, you take the adoption credit in the year the expenses were paid.</li>

<p>For example, you adopted a child in 2009, but you paid adoption expenses in 2008, 2009, and 2010. Your 2008 expenses are taken on your 2009 tax return (they must be delayed by one year because the adoption was not final). Your 2009 expenses are taken on your 2009 tax return (because they occurred in the same year as the adoption became final). You take your 2010 expenses on your 2010 tax return. In this example, your 2009 adoption expenses include costs incurred in both 2008 and 2009.</p>
<p><strong>If the child is a foreign national</strong>, then you take the adoption credit only in the year when the adoption becomes final. Any expenses paid in the year after the adoption is finalized, you can take a credit for those expenses in the year that you paid them.</p>
<p>If your adopted child does not yet have a Social Security Number, you must apply for an Adoption Tax ID Number (ATIN) in order for you to begin claiming your adopted child as a dependent. <h3>Carrying Forward the Adoption Credit</h3>
<p>Any adoption credit in from 2009 and before or 2012 and after that was in excess of your tax liability can be carried forward to the subsequent tax year. Excess adoption credits can be carried-forward for five years and is used up on a first-in, first-out basis.</p>
